We all understand that the Landlords have an absolute power of their land and, regardless of any contract obligations, their rights are definitely protected. Obviously, we also understand that the property should bear an income, and not just obligations. Here is the point of balance between benefits of owing the land and inconvenience of sharing it.

Not every Landlord will agree to share his ownership and to be involved in common regulation and admit some restrictions. Furthermore, the additional emotional stress can be consistently present during the renting of the property. However, in case of a side judge, who will resolve all the issues on a daily basis, together with the ability of fast rent agreement termination and the security deposit compensation, if any problem occurs, should make this renting process for Landlords highly beneficial and emotionally stress-free.

What about the Tenant? This is much more complicated and risky. The Tenant, of course, cannot have equal rights in this situation. In case of strictly following the rules of the Rent Agreement, the Tenant will secure the rights to live on the rented land and be a homeowner as long as the Rent Agreement is valid. The guaranty of this Tenant’s behavior is the risk to lose the property, that is the modular home, which, in case of not complying with the Rent Agreement, will be removed from the property of the Landlord.

How to protect the Tenant?

First of all, we all understand, that there can be two cases: Force Majeure and the Tenant’s behavior. Let’s start with the Tenant’s behavior case. There may be a long list of different circumstances, that forces Tenant makes the wrong things. Let’s not discuss the reasons but concentrate on the solution. As we know, the termination is based on the Notice of termination and then on the Termination Letter, and it is not necessary to provide the reason of rent determination in it. All Tenant has to do is to execute the request to leave as a “must”. In this case Tenant has a right to sell his property to another Tenant during the six months period from the moment of the Termination Letter. After the Termination Letter takes force the Tenant vacates from the rent payment, but continues to pay utility and taxes. Could be that Tenant sells his property, and if YES, what is the selling price for his modular house may be? This is an open question, but according to the situation on the market, the interest to this kind of property by renting basis will be constantly increasing. Let’s see why. First, it is the property taxes. The assessment of the modular house is much less than on a house on the substructure, also the apartment rent cost is usually more than land renting. So just an economical factor suggests that the Tenant’s property will have the reasonable interest. The condition of the Tenant’s property, rent, utility and tax amount, location of the rented space and the situation in the market concurrently with the requested sale price makes the final determination in sales.  

Let’s assume that the Tenant is an ideal customer and is not guilty in the termination of the Rent Agreement. The Landlord may request to remove the Tenant’s property from the Landlord’s land. This case we can call as a Force Majeure. And this should be clear, that if the Tenant has no involvement by his behavior or presence in the decision of the Landlord to terminate the Rent Agreement, then Tenant should minimize his risks of losses. We have some suggestions how to do that. In case of Force Majeure the Tenant will be offered to relocate his property for the expenses of the Landlord. The place of relocation will be chosen from the available list of land for rent. Landlord also pays all Tenant’s obligations in concern with his property, described in the Rent Agreement.

Here are the basic principles of cooperation of Landlord and Tenant, and we believe that the strong legal advice will help to finalize the Rent Agreement Terms for mutual benefits. Once again, we have a huge interest from both sides, the Landlord and the Tenant, to use the situation in Silicon Valley for their personal gain, and if so, it should be an honest and reasonable solution.
